Terms and conditions of the "KION Holiday Competition" competition
1. The "KION Holiday Competition" is organised and run by KION GROUP AG, Thea-Rasche-Str. 8, 60549 Frankfurt (hereinafter referred to as the "Organiser").
It begins on 7 December 2023 at 12:00 and ends on 19 January 2024 at 18:00
2. Conditions of participation
All natural persons who are at least 18 years old, have their own Instagram profile and are resident in the Federal Republic of Germany are eligible to participate. Employees of the KION Group and their family members as well as all other persons involved in the creation or implementation of the competition are excluded from participation. Multiple entries are not permitted. By liking and commenting on the competition entry as described in section 4 of these conditions of participation and thus participating in the competition, participants declare that they agree to the conditions of participation and data protection information listed here.
3. Prize
The following prize will be drawn from all participants who have answered the competition question correctly:

Week 2:
Linde toy forklift worth €182.99
Week 3:
Dematic towel and bathing stuff worth €30.00
Week 4:
Forklift truck and VW T2 Bus collector's set worth €31.95
4. Competition procedure
Participation in the competition is exclusively online via the KION Group's Instagram page ( https://www.instagram.com/KIONGroup ). A winner will be selected at random from all participants who like the published competition post and post the correct answer to the competition question using the comment function under the competition post within the competition period specified in section 1. Answers to comments will not be included.
5. Processing of the competition
The prize cannot be paid out in cash, exchanged or transferred to another person. The winners will be notified on 5 January via a direct message on Instagram. The prize will be sent by post to the postal address provided by the winners. If the winners do not respond to the prize notification within five days or if the prize is returned, they will forfeit their claim to the prize and a new winner will be selected at random. If the contact details provided are incorrect (e.g. incorrect address), the organiser is not obliged to find the correct address.
6. Warranty / early termination / exclusion from participation / liability
The Organiser does not guarantee the availability of the official Instagram page of the KION Group. The Organiser reserves the right to cancel or terminate the competition in whole or in part at any time, even without observing deadlines, if its proper execution can no longer be guaranteed for technical, legal or other reasons. The organiser is entitled to exclude participants from the competition without notice if they do not meet the above requirements or if they manipulate or attempt to manipulate the competition, in particular the entry process, and/or violate these conditions of participation.
There is no entitlement to the realisation of or participation in the competition. The organiser shall be liable without limitation in the event of intent and gross negligence and in the event of culpable breach of material contractual obligations. In the event of a breach of

7. Data protection information
The KION Group processes the personal data provided by the participants (name, address, public profile information, including user name and comments submitted (text and image)) only for the purpose of organising the competition and communicating with the winners. This data will not be passed on to third parties.
This does not apply to affiliated companies of the processor within the meaning of sec. §§ Section 15 AktG and service providers that are necessary for the realisation of the competition. These may be based in a third country outside the EEA. The provision of personal data is voluntary. However, participation in the competition is not possible without it. With regard to the use of the data you provide, please also note the data protection information of the respective platform on which the competition takes place.
We need to process the following data in order to send you the prize: Full name, e- mail address and postal address.
8. Miscellaneous
The competition is in no way connected to Instagram and is in no way sponsored, supported or organised by Instagram. Any questions or comments regarding the competition should not be addressed to Instagram, but directly to socialmedia@kiongroup.com. Reference is made to Instagram's terms of use. Participants indemnify Instagram against all third-party claims in connection with participation in the competition.
9. Final provisions Legal recourse is excluded. These conditions of participation and the entire legal relationship between the participants in the competition and the organiser are subject exclusively to the law of the Federal Republic of Germany. For legal disputes arising from or in connection with this competition, the place of jurisdiction shall be the organiser's registered office, insofar as this can be agreed. Should individual provisions of the conditions of participation be or become invalid, the validity of the remaining conditions of participation shall remain unaffected.
